ELIGIBILITY:
The Welcome Home Sullivan Giveaway IS OPEN TO NEW RESIDENTS OF SULLIVAN COUNTY WHO ARE TWENTY-ONE (21) YEARS OF AGE OR OLDER AT TIME OF ENTRY OR THE POST-MARK DATE OF THE U.S. MAIL POSTCARD ENTRY. Employees of Bethel Woods Center for the Arts Inc. (sometimes “Bethel Woods”), The Museum at Bethel Woods, Sullivan Renaissance, Sullivan 180, The Gerry Foundation, Inc., Granite Associates LP, Ovations Food Services LP, (“Ovations”), Sky Retail, and the subsidiaries, shareholders, members, partners, trustees, and representatives of each of the foregoing entities (and the immediate family members of all such employees, shareholders, members, partners, trustees, and representatives of such entities and all others with whom they are domiciled) are not eligible to win prizes. The The Welcome Home Sullivan Giveaway is subject to all U.S. federal, state, and local laws and regulations and to the rules and regulations of the Bethel Woods Center for the Arts as they might be promulgated from time to time. Giveaway subject to artist approval on a per concert basis. VOID WHERE PROHIBITED.
PROMOTION DESCRIPTION:
The Welcome Home Sullivan Giveaway (the "Giveaway") is a sweepstakes promotion in which entrants will be eligible to win one (1) grand prize per eligible.
There will be One (1) grand prize (per eligible concert) consisting of:
- Pair of tickets to a 2021 Bethel Woods Pavilion concert of their choosing, subject to availability.
- What Sullivan Renaissance is offering (garden/landscaping consultation, etc)
- What Sullivan 180 is offering
- Variety of local Sullivan County products
The prize will be awarded to one person who enters no later than 11:59 PM on 07/02/2021 or postcard entrant (official determination by Bethel Woods through Ticketmaster). For the avoidance of doubt, no purchase is necessary to participate in the Giveaway., they shall be deemed a ticket purchaser for purposes of determining the winner.
Alternative Means of Entry: To enter without purchase, send in a 3"x 5" postcard with your name, address, and your complete and accurate email address you can register free of charge The Welcome Home Sullivan Giveaway. P.O. Box 222, Liberty, NY, 12754. For postcard entries, only one entry per person is permitted per eligible concert; if the same person submits multiple postcard entries, only the first postcard entry shall be deemed valid and counted and the remainder of the postcard entries by that person shall be deemed void,
of no effect, and not counted.
ODDS:
The odds of receiving the prize depend on the number of eligible entries received during the Giveaway Period and is dependent on the number of bags picked up and eligible postcard entries received.
WINNING AND NOTIFICATION:
The winner will be notified by e-mail on July 6, 2021. Prize winners are solely responsible for the reporting and payment of all taxes on the value of the prize. Any winner may waive his or her right to receive the prize, by any one of the following methods:
- At the time the winner is notified by email, the winner may waive the prize, in which case the prize will not be delivered if the winner has delivered a signed, written waiver to Bethel Woods;
or (b) After delivery of the prize, the winner may return the prize to Bethel Woods, along with a signed, written waiver, in which case the winner shall be responsible for all shipping costs in order to return the prize. No cash or other substitution is allowed. Rights to receive a prize are non-assignable and non-transferable. Submission of a name and email address constitutes the entrant’s representation that he or she is eligible to participate in accordance with these Official Rules and Restrictions.
Winners
If the winner selected does not respond to Bethel Woods’ notification within seven (7) days of the sending of the first of Bethel Woods’ notifications to the winner, an alternate winner will be selected, and the prior winner shall have forfeited all rights to the prize if there is no timely response to the Bethel Woods notification. You must submit your correct and complete email address in order to receive your email notification. The prize winner and travel companion may be required to execute and return an Affidavit of Eligibility, Release of Liability and/or Prize Acceptance Form within seven (7) days following notification, or longer if permitted by Bethel Woods. Entry also constitutes the entrant’s consent to the use and publication of his or her names and/or images (as well as those of their companions participating in the prize) on the Bethel Woods web and social media pages, and to the inclusion of his or her names and/or images in any other publications, or media, including without limitation, radio, television, print or web sites for any commercial or promotional purpose, without limitation and without compensation.
GENERAL CONDITIONS:
The prize is not transferable. The prize cannot be redeemed for cash value. Bethel Woods, Sullivan 180 & Sullivan Renaissance reserves the right to substitute a prize of equal or greater value in the event the offered prize is unavailable.
- Winner's contact information must have both: Correct, legible and complete name, email address, and mailing address in database management program (for online and postcard entries)
Entries will be automatically disqualified if the above conditions are not met.
Participation constitutes an agreement by each entrant to comply with these Official Rules and Restrictions. Bethel Woods reserves the right at any time to cancel or modify this Giveaway for any lawful reason, including but not limited to its determination, in its sole discretion, that fraud, misrepresentation, or technical failures have diminished or destroyed the integrity of the Giveaway or that the Giveaway is not otherwise capable of completion as planned.
By entering, entrants release and hold harmless Bethel Woods Center for the Arts Inc. (sometimes “Bethel Woods”), The Museum at Bethel Woods, Sullivan Renaissance, Sullivan 180, The Gerry Foundation, Inc., Granite Associates LP, Ovations Food Services LP, (“Ovations”), Sky Retail its and everyone of their respective parents, subsidiaries, affiliates, directors, members, officers, employees, attorneys, agents and representatives from any and all liability of any kind or nature whatsoever and for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with, the Giveaway or any prize won or applied for, any misuse or malfunction of any prize awarded, participation in any Giveaway-related travel or activity, or participation in the Giveaway.
By participating in the Giveaway, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Giveaway, or any prizes awarded, used, or applied for, shall be resolved individually, without resort to or participation in any form of class action; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Giveaway, but in no event attorney's or other fees or legal or investigative costs; and (c) under no circumstances will any entrant or party related thereto be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
By participating in the Giveaway, each entrant agrees to permit Bethel Woods Center for the Arts and its affiliates to use, without notice or further compensation, worldwide and in perpetuity in any and all forms of media, now known and hereafter devised, such winner’s name, likeness, pictures, photographs, voice, biographical information, and statements for purposes of advertising, trade, promotion, and publicity, except where prohibited by law.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Bethel Woods, or any related persons or entities, in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law rules or provisions (whether of the State of New York, or any other jurisdiction).
The Welcome Home Sullivan Giveaway is sponsored by Bethel Woods, Sullivan Renaissance, and Sullivan 180 whose decisions regarding the selection of winners and all other aspects of the Giveaway shall be final and binding in all respects. No other entity is a sponsor of this Giveaway. The organizations will not be responsible for typographical or other inadvertent errors in these Official Rules or in other Giveaway materials.
